PERMITTED USE: |
Used exclusively as general office, service and sales, and no other purpose. |
SERVICE CHARGE: |
Tenant’s failure to make any payment required within 5 days of the due date shall result in a fee of 5% the amount due. |
DELIVERY OF SPACE: |
Tenant shall accept the space “As Is” with a $XXX,000 Improvement Allowance ($45.00/sf). |
OPERATING EXPENSES: |
Landlord shall provide a Base Year 2023 operating and property tax expense stop grossed up to 100% occupancy with a 5% cap on operating expense increases. |
EXPANSION OPTIONS: |
Tenant shall have a Right of First Refusal (ROFR) on all adjacent space in the building along with an ongoing co-terminus expansion option at the prorated leasing terms. |
RENEWAL OPTIONS: |
Tenant shall have two (2) x 5-year renewal options at 90% of then current market with 90 days advance, written notice. Each renewal option shall trigger an updated operating & tax expense stop. |
SIGNAGE: |
Tenant shall, at its own cost and expense, erect a sign ("Sign") on the exterior of the Building. The location, style, size, and all other aspects of the Sign shall be subject to Landlord's prior written approval. |
LL REPAIRS & MAINTENANCE: |
LL shall maintain in good order the roof, exterior and interior load-bearing walls, structural components of the building, and other common areas of the building. |
TENANT REPAIRS & MAINTENACE: |
Tenant shall maintain and keep in good order the interior of the space, including all interior maintenance and cleaning services. |
ASSIGNMENT & SUBLETTING: |
Tenant shall not assign or sublet the premises without prior written consent of the LL. The granting or withholding of such consent shall not be unreasonably withheld. |
HOLDING OVER: |
150% of last current month of Base Rent & Rent Adjustment. |
